MiAGon is a division of Divine
Generation, LLC and does not operate independently of its parent
company. MiAGon provides, but is not limited to, the following
services: logo design, graphics design, web site design, web site
hosting, e-commerce solutions, etc. Although not its primary line of
business, MiAGon may, upon request and under contract, provide other
services and taxable products.
Contractual Relationship
MiAGon may, at its discretion, provide a potential client with freee
consultation and initial analysis, as well as provide some services
outside and prior to the completion and signing of a service contract.
During this pre-contract stage, the client may not hold MiAGon
responsible for any actions taken by MiAGon or the client, nor will
the client hold MiAGon responsible for any deliverables, as a contract
is not in effect.
A completed and signed service contract between MiAGon and its client
for services to be performed or products to be sold to the client is
only valid when the required desposit amount is paid to MiAGon, where
applicable. Service contracts that do not require a deposit are
immediately active the moment both parties intitiate the contract with
their signatures.
Upon completion of the work promised by the service contract, the
client will be asked to sign off on the deliverables, thus, closing
any deliverable obligations stated in the contract. This does not
terminate the privacy disclosures or ongoing responsibilities stated
in the contract by MiAGon, only the deliverables.
Liabilities
MiAGon offers multiple services and products, some of which are
offered through 3rd party sources and vendors to reduce costs that, in
turn, pass the savings to its clients. MiAGon is only liable for
services and products provided under our complete control. Such
services include, but is not limted to: logo design, graphics design,
and web site design, etc. These services are provided under MiAGon's
full control and are all in-house, therefore allowing us to control
the process and outcome. Other services and products such as domain
registration, web site hosting and related hosting services are not
controlled entirely by MiAGon, therefore, we are not held liable for
the provider or vendor's ability to deliver.
In the very unlikely event that a 3rd party provider or vendor cannot
deliver on their service or products to MiAGon, thus, impacting
MiAGon's client, MiAGon will try to correct the problem at no cost to
its client. Should this not be feasible, MiAGon can offer a refund on
the services or products impacted.
MiAGon also transfers and exercises the disclaimers and contract
conditions of its 3rd party providers and vendors to its clients and
is not held responsible for the lack of provision to its clients when
its 3rd party providers or vendors are not able to deliver said
services or products.
An example of such a transferable liability from MiAGon's 3rd party
provider or vendor to its client would be it's client web site
experiencing downtime due to a problem with the hosting provider.
MiAGon is not responsible for any damages incurred by its clients in
excess of the original contract value.
Privacy
MiAGon values its clients and their privacy. MiAGon does not sell,
rent, lease, trade, or provide to any person, business or entity any
information about its clients nor its relationship with said clients.
Any and all information gathered from its clients is strictly for
internal record management use only.
All customer records and information are maintained on seperate
systems inaccessible from outside our networks, ensuring the ultimate
privacy for our customers. |
